Reservation of Remedial Rights

As demonstrated by the following exemplars, the parties may clarify that any remedial right that is contractually available for breach is not exclusive and that the parties do not waive the right to pursue other remedies available under the law or equity:

Exemplar C61A-1

The rights and remedies of the Parties hereunder are cumulative and not exclusive of any right or remedy that may be available to any Party whether at law, in equity, or otherwise. The exercise of any right or remedies hereunder or otherwise available, are in addition to any other right or remedy that may be otherwise available and will not be construed as an election of remedies to the extent permitted by applicable law.

The termination right provided in this clause is without prejudice to any other rights or remedies available to Customer under the Agreement or otherwise in law or regulation.

This Agreement is provided to you without prejudice and does not purport to address all facts and issues concerning the Claim. Contractor expressly reserves all rights, remedies, claims, and defenses available to it under applicable law.
